New rules for Domain Name Dispute Resolution Procedures at WIPO
For unambiguous cases, in which a domain name needs to be retrieved, the Domain Name Dispute Resolution Procedure of the WIPO (World Intellectual Property Organization) lends itself excellent. This Domain Name Dispute Resolution Procedure offers a fast and non-expensive solution to retrieve a domain name that infringes a brand- or trade name. The procedure at the WIPO is completely digital and in principle the judgment will be given within two months.
Recently, the WIPO adopted new rules to enhance the streamlining of its approach on the WIPO Mediation, the Arbitration Procedure and the Expedited Arbitration Procedure. The rules focus, among others, on the joinder of additional parties to proceedings that is cost effective. Another new rule is to consolidate a procedure with a case that is already pending. In addition to the new rules there is now also a preliminary possibility to have an emergency relief procedure before the Domain Name Dispute Resolution Procedure.
The new rules of the WIPO will find enforcement on the first of June 2014.
